These terms and conditions set out the basis on which TMurphyPhotography ("we", "us" or "our") provides its photography and video services ("Services") to real estate agents or Client ("you").
1| If you cancel the Services before 4pm on the day before your appointment, no fee will be incurred. If you cancel the Services after 4pm on the day before your appointment, you will be charged a $33 Fee.
2| All fees for the Services are inclusive of GST.
3| Payments must be received within 30 days from the date of invoice regardless as to when our invoice is received. If payment has not been received within 30 days an account keeping fee will apply at the monthly rate of 1.5 on overdue outstanding balances or $30.00 whichever is the greater.
4| Where properties are located outside a 50km radius of Maitland-Newcastle CBD, fees for travel time will be charged at $0.55 per kilometer.
5| We will invoice you within 7 days of completion of the Services.
6| Payment must be made in accordance with the terms of the invoice.
7| We retain ownership of all intellectual property and other rights in any materials or photographs produced or created by us during the provision of the Services. You are granted an irrevocable, royalty free license to use those materials in all media throughout Australia for promotional purposes only.
8| Using the photography for any other purpose without consent of TmurphyPhotography or the photographer is strictly prohibited and can incur a penalty depending on the breach of copyright. A copyright fee will apply to use the photography for a purpose other than for which it was commissioned, at the discretion of the photographer or TmurphyPhotography.
9|You agree to inspect all services and/or products and notify us of any defects within 5 working days of the creation of the services and/or products, failing which we will have no liability for any defects.
10|You will allow us 2 working days to remedy any defects or problem once we are notified in writing of the defect.
11| Any property photographed by TmurphyPhotography for another agency will need to be purchased for $66 including GST after expiration of the agency agreement irrespective of whether the vendor paid for the photography or the agent paid for the photography in first instance. Third party websites may purchase the photography from TmurphyPhotography or the photographer at a price to be determined according to the purpose of use and length of use.
